Terms of Service

These Terms of Service ("Terms") govern your use of the Mismop mobile application and the mismop.io website (together, the "Service"), provided by Mismop ("Mismop", "we", "us", "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What Mismop is — and what it isn't
Mismop is a tool that guides renters through documenting the condition of a rental property at move-in and move-out, so they can preserve evidence in the event of a security-deposit dispute.
Mismop is not a law firm and does not provide legal advice. We do not estimate the dollar value of damages or deposit deductions, we do not represent you in any dispute, and our AI-generated guidance is informational only. For legal advice specific to your situation, consult a licensed attorney in your jurisdiction.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) and able to form a legally binding contract to use the Service.
3. Your account and access
Mismop uses an email-based, no-password access model. We send you a private "magic link" to your email address that grants access to your inspection record. You are responsible for keeping your email account secure. Anyone with access to your email may be able to access your Mismop record.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or to fabricate evidence.
- Upload photos, videos, or content depicting other people without their consent where consent is required by law.
- Attempt to access another user's record or any portion of the Service that you are not authorized to access.
- Reverse-engineer, decompile, or otherwise attempt to derive the source code of the app, except to the extent permitted by applicable law.
- Interfere with or disrupt the Service, including by submitting malicious code, abusive automated requests, or content that overloads our infrastructure.
5. Subscriptions and billing
Some features of the Service require a paid subscription. Subscriptions are sold through the Apple App Store or Google Play, and billing is handled by Apple or Google according to your account settings on those platforms.
- Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period.
- To manage or cancel a subscription, use the subscription settings in the App Store or Google Play app on your device.
- Refunds are handled by Apple or Google under their respective policies.
- Prices may change. We will notify you in advance of any change that affects your active subscription.
6. Your content
You retain all rights to the photos, notes, and other content you submit to the Service ("Your Content"). You grant Mismop a limited, worldwide, royalty-free license to host, store, process, analyze, and transmit Your Content solely to provide and improve the Service for you (including running AI defect detection and form auto-fill on your behalf, and emailing your record).
You are responsible for ensuring that you have the right to upload Your Content and that it does not violate the rights of any third party or any applicable law.
7. AI output
The Service uses AI models to identify potential damage, compare photos, and extract fields from inspection forms. AI output may be incomplete, inaccurate, or wrong. You are solely responsible for reviewing AI output before relying on it, sending it to a landlord, or using it in any dispute. Mismop makes no warranty that AI output is accurate, complete, or fit for a particular purpose.
8. Third-party services
The Service relies on third-party providers (including Supabase, OpenAI, Amazon Web Services, Resend, Apple, and Google) to operate. Your use of the Service is also subject to their applicable terms. We are not responsible for the practices of any third-party service.
9. Intellectual property
The Mismop name, logo, app, and website (excluding Your Content) are owned by Mismop and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes, subject to these Terms.
10. Disclaimers
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
11. Limitation of liability
To the maximum extent permitted by law, Mismop and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid Mismop in the 12 months before the claim arose, or (b) USD $50.
12. Indemnification
You agree to defend, indemnify, and hold Mismop harmless from any claim, demand, or expense (including reasonable attorneys' fees) arising out of your use of the Service, Your Content, or your violation of these Terms.
13. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service if you breach these Terms or if we are required to do so by law. Sections that by their nature survive termination (including ownership, disclaimers, limitation of liability, and dispute resolution) will continue in effect.
14. Governing law and disputes
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of those courts.
15. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will update the "Last updated" date at the top of this page and, where appropriate, notify you in the app or by email. Continued use of the Service after a change indicates your acceptance of the updated Terms.
